Terms and Conditions

These Terms and Conditions (“Agreement”) govern your use of GRAVITATE Studio’s (ABN 99 644 955 000) facilities and services. By booking and using GRAVITATE Studio, you (“Client”, “your”) agree to comply with and be bound by this Agreement.

Definitions

Booking: refers to the reservation made by the Client for the use of GRAVITATE Studio's facilities and/or equipment and services at a specified date and time. This includes the selection of any additional services or equipment rentals chosen by the Client. A Booking is confirmed upon receipt of full payment and acceptance of these Terms and Conditions.

Client: refers to the individual or entity making the Booking with GRAVITATE Studio or renting studio equipment. The Client is responsible for adhering to the Terms and Conditions set forth in this Agreement and ensuring compliance by all individuals involved in the use of GRAVITATE Studio and GRAVITATE Studio equipment during the reserved time. Client includes all guests, employees, contractors, and any other persons the Client brings into GRAVITATE Studio or uses GRAVITATE Studio equipment while rented. The Client must ensure that all such individuals follow the GRAVITATE Studio’s Terms and Conditions, Health and Safety Guidelines, and any specific instructions provided by the GRAVITATE Studio team.  

Booking and Payment

  • Booking Confirmation: Your Booking is confirmed upon receipt of full payment.
  • Payment: All payments must be made in advance of your Booking via the provided payment methods. A Booking is only confirmed once the payment has been processed.
  • Overtime: Additional time in GRAVITATE Studio following your Booking, will incur an overtime fee of $120 + GST per hour. This will be invoiced to you after your Booking and is payable within 7 days. 

We understand that plans can change, and we aim to be as flexible as possible while respecting the time and resources involved in managing studio bookings.

Cancellation Policy

  • More than 72 hours (3 days) notice: Cancellations made more than 72 hours before your scheduled Booking will receive a full refund.
  • Between 24–72 hours notice: Cancellations made within this window will incur a cancellation fee of $150 + GST, invoiced and payable within 7 days of the original Booking date.
  • Less than 24 hours notice: No refund will be issued for cancellations made within 24 hours of the Booking. The full Booking fee will be forfeited.

Reschedule Policy

  • More than 72 hours (3 days) notice: You may reschedule your booking once at no additional cost, subject to availability.
  • Between 24–72 hours notice: Rescheduling within this window will incur a $75 + GST reschedule fee. We will do our best to accommodate your preferred new time.
  • Less than 24 hours notice: Unfortunately, rescheduling is not available within 24 hours of the booking. A new booking will need to be made at full cost.

GRAVITATE Studio Cancellation

  • GRAVITATE Studio reserves the right to cancel any confirmed booking at any time, without cause. In the event that GRAVITATE Studio must cancel a booking, we will make every reasonable effort to provide as much notice as possible and to offer an alternative booking time or refund any payments made for the cancelled session. However, GRAVITATE Studio shall not be liable for any costs, damages, or losses incurred by the client as a result of the cancellation.

Client Liability Insurance

  • The Client is required to have liability insurance that covers their activities at GRAVITATE Studio and/or the use of GRAVITATE Studio equipment.
  • GRAVITATE Studio may request a copy of the Client’s Certificate of Currency at any time.

Use of Studio

  • Permitted Use: GRAVITATE Studio may only be used for the purpose specified at the time of Booking.
  • Prohibited Activities: Drinking alcohol, smoking, vaping, illegal activities, and any form of hazardous materials are strictly prohibited within GRAVITATE Studio premises.
  • Conduct: Clients and their guests must conduct themselves in a professional manner and respect the property and staff at all times.

If any of the above conditions are breached, the Client will be asked to leave and will not be refunded their Booking fee. 

 Equipment and Facilities

  • Sound and Shared Facilities: GRAVITATE Studio is part of a collaborative shared workspace, and as such, GRAVITATE Studio cannot guarantee 100% silence or exclusive access to the shared facilities such as the bathroom.
  • Equipment Use: By hiring or using equipment at GRAVITATE Studio, you agree to the following:
    1. Availability Not Guaranteed: Equipment hire is subject to availability at the time of your booking. GRAVITATE Studio cannot guarantee that specific items will be available, even if listed or previously requested.
    2. Condition & Responsibility: All equipment is provided in working order. You are responsible for the safe and appropriate use of all hired and/or provided equipment during your booking.
    3. No Training Provided: No training, instruction, or supervision is provided. You must ensure you understand how to correctly and safely operate the equipment you hire and/or are provided.
    4. Damage & Loss: You are financially responsible for any loss, theft, or damage (beyond reasonable wear and tear) that occurs while the equipment is in your care, whether caused by you, your team, clients, or talent.
    5. Liability: GRAVITATE Studio is not liable for any injury, loss, or damage arising from your use or misuse of studio equipment.
    6. Inspection & Reporting: You must notify us immediately if equipment appears damaged, unsafe, or faulty. Continued use after noticing a fault is at your own risk.
    7. End-of-Hire Check: All equipment must be returned and checked in before the end of your booked session. Late returns may incur fees.

Damage or Loss 

  • Clients are responsible for any damage to or loss of studio equipment, the cyclorama and facilities during their Booking. 
  • If GRAVITATE Studio's cyclorama is left in a condition that cannot be cleaned (e.g., cannot be restored by mopping), a repainting fee of $120 + GST may be charged. Minor cleaning may be charged for marks and scuffs of $50 + GST.
  • A bill will be issued for the cost of the repairs or replacement, with payment required within 7 days of the damage identified. The reasonable cost will be determined by GRAVITATE Studio. 

Health and Safety

  • Compliance: Clients must comply with all health and safety regulations and guidelines provided by GRAVITATE Studio. 
  • Accidents and Injuries: GRAVITATE Studio is not liable for any accidents or injuries that occur on the premises. Clients are responsible for ensuring their own safety and the safety of their guests.

Add-Ons

  • Behind the Scenes Footage: If booked, our videographer will capture behind-the-scenes raw footage of your session. The raw footage will not be edited, unless another scope of work is agreed to. All footage will be provided via a link to Google Drive Folder as per the agreed terms and timeline.

Intellectual Property

  • Ownership: All creative content produced during the booking remains the property of the Client. GRAVITATE Studio retains no rights over the content created by Clients.
  • Usage Rights: GRAVITATE Studio may request permission to use behind-the-scenes footage or images for marketing purposes, subject to Client approval.

Liability and Indemnity

  • Limitation of Liability: GRAVITATE Studio’s liability for any claim arising out of this Agreement shall not exceed the total amount paid by the Client for the Booking.
  • Indemnification: Clients agree to indemnify and hold GRAVITATE Studio harmless from any claims, damages, liabilities, and expenses arising out of or related to their use of GRAVITATE Studio during the Booking.

Confidentiality

  • Client Information: GRAVITATE Studio will not disclose Client confidential information to third parties without prior consent, except as required by law.

Marketing 

By booking a session at GRAVITATE Studio or hiring equipment, you acknowledge and agree that we may request permission to capture and use behind-the-scenes (BTS) footage of your shoot for marketing purposes. This content may be utilised to promote GRAVITATE Studio across various platforms. Additionally, by making a booking, you consent to receive marketing materials from us, including updates on promotions, events, and services related to the studio. We respect your privacy and will only use your content and contact information as outlined in these terms.

Force Majeure

  • Unforeseen Events: GRAVITATE Studio is not liable for any delay or failure to perform its obligations due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, and government actions.

Amendments

  • Changes to Terms: GRAVITATE Studio reserves the right to amend these Terms and Conditions at any time. Please refer to GRAVITATE Studio’s website for the most up to date Terms and Conditions.

Governing Law and Jurisdiction

  • Applicable Law: This Agreement shall be governed by and construed in accordance with the laws of New South Wales, Australia.
  • Dispute Resolution: Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

Off-Premise Equipment Hire Additional Terms and Conditions

By hiring equipment from GRAVITATE Studio for use outside the premises, you also agree to the following legally binding terms:

  • Availability Not Guaranteed: All hire requests are subject to equipment availability. GRAVITATE Studio makes no guarantee that any specific item will be available at a given time, including where equipment has been previously reserved.
  • Equipment Ownership & Condition: All equipment remains the property of GRAVITATE Studio. Equipment is tested and supplied in working order. You accept full responsibility for its condition from collection to return.
  • No Training Provided: No training, setup assistance, or operational guidance is provided. You acknowledge that you (or your team) are competent to use the equipment safely and correctly.
  • Hire Period & Late Fees: The hire period begins at collection and ends once equipment is returned and checked in by the GRAVITATE Studio team. Late return fees apply and may be charged daily.
  • Damage, Loss & Replacement: You accept full financial liability for any loss, theft, or damage to the equipment during the hire period, regardless of cause. If repair is possible, you will pay repair costs. If equipment is lost, stolen, or damaged beyond repair, you will pay full replacement value.
  • Security Bond / Payment Authorisation: GRAVITATE Studio may require a security bond or pre-authorisation. You authorise us to charge any amounts owing for repair, replacement, or late return.
  • Safe & Legal Use: You agree to use the equipment with care, for lawful purposes only, and in accordance with manufacturer guidelines. You must not modify or alter the equipment in any way.
  • Liability & Indemnity: GRAVITATE Studio accepts no responsibility for injury, damage, or loss resulting from your use or misuse of the equipment. You indemnify GRAVITATE Studio against all claims, damages, and costs arising from the hire or use of the equipment.
  • Inspection, Faults & Failure to Notify: You must inspect the equipment at pickup and notify GRAVITATE Studio immediately of any issues. Failure to report damage at pickup means the equipment will be assumed to have been supplied in good condition.
  • Return & Check-In Requirements: All equipment must be returned clean, complete and in the same condition as supplied. Missing, dirty, or damaged items may incur cleaning or replacement charges.
  • Termination of Hire: GRAVITATE Studio reserves the right to recall equipment at any time.

Acceptance

By making a booking with GRAVITATE Studio and/or hiring equipment, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
